Apple Sued For Using ‘iPad’ Name in China

Apple seems to be in trouble for using the "iPad" name in China.

iSmashPhone reports that Apple could be fined 240 million yuan ($38 million) by government authorities over alleged trademark infringement involving the "iPad" name.

But the $38 million fine just seems to be tip of the iceberg as Proview Technology is also suing Apple for $1.6 billion. It also wants Apple to apologize and is seeking an injunction that prevents the company from using the iPad name in China.

Proview Technology had first filed a trademark infringement lawsuit against Apple in 2010, claiming it owned the "iPad" trademark in China since 2000. At that time it was demanding $800 million from Apple. Apple had countersued Proview claiming that they owned the "iPad" trademark as they had bought European rights to the "iPad" trademark from Proview's parent company for $55,000, which also included China.

Back in December, Apple lost the lawsuit as the court ruled that Proview's parent company did not have the authority to sell them. Apple is appealing the December ruling that favored Proview.

    I’m not china copies evrything and gives companies back zero! Look at all the iPhone copies and now there doing the same with the cars, have you seen chinas version of BMW x5. China your the biggest copy cats!

    Not surprising at all really. Did you know that Apple bought the rights to use “iOS” from Cisco Systems. Go have a look for yourself. I dont see why they cant come up with their own names for products? I hope this Chinese company wins.

    these people are all out for a quick buck… 1.6 billion for a lawsuit? incredible!!! i wonder how they derived the figure. did they experience loss of income/sales due to the iPad name?

    How can a Chinese company sue apple for for this when China makes illegal copies of iPhones and sells them under the same name without permission from Apple or revenue given to them? What a bunch of hippocrits. China has already proven patents don’t mean a thing to them and yet it’s fine the other way around?

      You cant blame the one company on something that another company has done. Even if they are both from China. Apple has bought rights from the company for use of the “iPad” name with conditions. Due to those conditions, Apple should have either negotiated the terms, sold the iPad under a different name or not sold the iPad in China. Apple wants to break contract, now they face the consequences.

        Apple bought without conditions for 55 K USD years ago
        But since Apple start to sell Ipad in China , proview sniff money and want to get more money out of the deal
        Chinese forget Apple is a big tax payer , and provide work for thousend workers
        Who gonna feed them and their family if Apple move to India ?
