Apple and Australian Regulator Unable to Reach Deal on Branding of 4G LTE iPad

An agreement regarding the branding of the 4G LTE version of the new iPad is continuing to be an area of dispute between Apple and the Australian Competition and Consumer Commission.

The ACCC wants Apple to change the name of the 4G LTE iPad after the branding of the device as “iPad Wi-Fi + 4G” mislead customers to believe that the new iPad could run on and access any 4G LTE network in Australia.

According to AppleInsider, the Cupertino-based company and the Australian regular took part in a mediation on Monday and could not reach a compromise.

Because no deal was reached, there will be a hearing with Justice Mordecai Bromberg of the Federal Court in Melbourne. Though the two sides came to terms on other matters, the name of the new 4G-capable iPad remains a sticking point between Apple and the ACCC.

The actual mediation was closed off to the media, however, Apple had reached terms with the ACCC in other aspects of consideration. Firstly, they agreed to update its website to inform potential customers that the new iPad is sold that the device is not compatible with any Australian 4G LTE and WiMAX networks.

As another measure, Apple sent out emails to all of its Australian customers offering them a full monetary refund if they felt they were confused over iPad 3’s 4G capabilities.

“The ACCC alleges that Apple’s recent promotion of the ‘new iPad with WiFi + 4G’ is misleading because it represents to Australian consumers that the product ‘iPad with WiFi + 4G’ can, with a SIM card, connect to a 4G mobile data network in Australia, when this is not the case,” the ACCC said publicly.

While Apple quickly updated the text accompanying the “iPad Wi-Fi + 4G” on its online store to note the fact that the new iPad “is not compatible with current Australian 4G LTE networks and WiMAX networks”, as part of the first area of compromise with the ACCC, they’re still advertising the new iPad with its original name on the Australian Apple Store.
