Samsung, another high profile company engaged in a legal dispute with Apple, has now asked a U.S. judge to turn over a copy of Apple’s agreement with HTC to know the extent to which the deal covered Apple’s patent portfolio.

Gartner’s quarterly report on the mobile phone market are out and unsurprisingly it’s a battle between Apple and Samsung, iOS and Android. Apple and Samsung together control almost half of the smartphone market—46.5%— and while Android controls over 50% of smartphone sales by OS, iOS is expected to narrow the gap in Q4. Really, the smartphone market is like an opera. We have two main players (Apple and Samsung) battling for our hearts and minds, while the rest of the field have their own parts to play.

Apple and HTC gave us a pleasant surprise over the weekend by announcing a 10-year cross-licensing deal and agreeing to drop all the patent lawsuits between the two companies.

This gave us some hope that Samsung and Google-owned Motorola would follow HTC’s footsteps and settle with Apple (so we can finally stop writing about these boring patent lawsuits).

The Verge reports that U.S. Customs officials have delayed shipments of HTC’s One X and Evo 4G LTE Android-based smartphones into U.S. to investigate if they still infringe on Apple’s patents.

Here’s some background. Back in March 2011, Apple had filed a lawsuit against HTC alleging that the Taiwan based handset manufacturer has infringed on nearly 20 of Apple’s proprietary inventions relating to the iPhone’s UI, architecture and hardware.
